The Trojan Horse at the Heart of Climate Change Legislation

Those who follow this blog know of our long standing interest in the use and protection of EPA's hard won right to regulate CO2 under the Clean Air Act. That is why the nearly secret inclusion of language which eviscerates (love that word!) precisely this power in the Waxman Markey climate change legislation is so disturbing. There is no better environmental legislator than Henry Waxman. Period. To have this master legislator include such a damaging provision simply means that the political power of polluters in the House is greater than the power of environmentalists. Which means we have to have a big fight over it.

You don't really get it, do you? Waxman is a LEGISLATOR. The EPA, with you cheering madly from the sidelines, is giving all the legislators the finger and essentially declaring that it will do whatever it wants about CO2 no matter what Congress says. And Congress don't like that at all--and they plan to say it with laws. Waxman isn't going soft on global warming (although he should) nor is he being a pawn of the "polluters". He's simply smacking the EPA (and people who think that it ought to have the power to act on whatever mad notion enters its numb skull) over the head with the fact that the EPA must bow to Congress or be smacked down hard.

I'm also curious why you disagree with this article. It's brimming over with the same irrational, uneducated, claptrap that you regularly advance about the climate. What, did he hurt your feelings by saying that the timid approach is useless? You've been saying essentially the same thing by demanding that the EPA be allowed to lord over anything related to anthropogenic global warming or greenhouse gases.

This sounds important, and I know you do great deal of work and sacrifice to get information out. It would be helpful to know what the number of the bill and perhaps the paragraph number(s) of the "trojan horse."
